The Internal Revenue Service (IRS) is introducing a streamlined approach to tax reporting for businesses operating in Puerto Rico and U.S. territories. This initiative involves standardizing forms, aiming to enhance your tax-filing experience by saving time and effort. Historically, Puerto Rico and U.S. territories utilized their unique forms for tax reporting. The IRS is now transitioning to standard forms, notably Form 940 and Form 941, to unify the process across all regions.
Form 940, utilized for reporting annual Federal Unemployment Tax Act (FUTA) tax, funds unemployment compensation for individuals who have lost their jobs. Notably, FUTA tax is an employer’s responsibility and is not deducted from employees' wages. Previously, businesses in Puerto Rico employed Form 940-PR for reporting their FUTA tax.
Form 941 is utilized to report income taxes, social security tax, and Medicare tax withheld from employee paychecks, also covering the employer's portion of social security or Medicare tax. Employers in Puerto Rico traditionally used Form 941-PR to report withholdings. Employers utilize Form 941-SS to declare social security and Medicare taxes for employees operating in American Samoa, Guam, the Commonwealth of the Northern Mariana Islands, and the U.S. Virgin Islands.
Beginning with filings for the tax year 2023, businesses that previously utilized Form 940-PR will transition to Form 940. Additionally, the IRS introduces a new Spanish-language Form 940 (sp) and Form 943 (sp) for agricultural employers in Puerto Rico reporting social security and Medicare taxes.
From the first quarter of 2024, Form 941-PR and 941-SS will be replaced with the standard Form 941, with an alternative Spanish-language Form 941 (sp) available.
