Attention, employers! Exciting changes are on the way for the onboarding process. Starting August 1, 2023, the U.S. Citizenship and Immigration Services (USCIS) will release an updated version of Form I-9, the Employment Eligibility Verification form. These updates aim to enhance the I-9 process, making it more convenient and efficient for businesses like yours during the onboarding of new employees.

Upcoming Changes to the I-9 Document

The revised Form I-9 will now include a checkbox specifically for employers enrolled in E-Verify. This checkbox allows employers to indicate that they have remotely examined identity and employment authorization documents using an alternative procedure authorized by the Department of Homeland Security (DHS). With these new updates, you can say goodbye to the hassle of in-person document examinations and welcome more flexibility in your onboarding process.

The revised Form I-9 will be reduced to a single-sided sheet and is designed to be easily accessible on any device for new hires. The form will also include helpful tips and links to information on automatic extensions of employment authorization documentation, ensuring you stay up to date with regulations.

Conclusion of Covid-19 Regulations

The DHS recently announced a final rule recognizing the conclusion of temporary COVID-19 regulations, effective July 31, 2023. However, employers will still have the option to remotely examine Form I-9 documents under the DHS-authorized alternative procedure.

To participate in this remote examination, employers must:

  • Be enrolled in E-Verify
  • Retain copies of all documents
  • Conduct a live video interaction with the employee
  • Create an E-Verify case if the employee is a new hire

Employers who were using E-Verify and checked their employees' documents during the COVID-19 flexibilities (from March 20, 2020, to July 31, 2023) have the option to switch to a new alternative process starting on August 1, 2023. This new procedure allows them to meet the requirement for physically examining documents by August 30, 2023. For employers who were not enrolled in E-Verify during the COVID-19 flexibilities, documents must be examined in person by August 30, 2023.
